The facts were that the Appellant a Sergeant in the Namibian Police Force together with a Junior Officer who is not involved in this appeal were charged with an offence of bribery. They were both convicted and sentenced to pay a fine of $3000-00 or 12 months imprisonment. During the trial the defence lawyer applied to have prosecution witness statements which had not been made available to the defence.
